1. Introduction

Welcome to Package PR. These Terms of Service ("Terms") govern your use of our website, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Definitions

"Package PR," "we," "us," and "our" refer to Package PR, Inc.

"You" and "your" refer to the individual or entity using our Services.

"Content" refers to any information, data, text, software, graphics, messages, or other materials that can be accessed through our Services.

"Storage Space" refers to the physical space in our Indiana warehouse where your items are stored.

"Storage Period" refers to the duration for which your items are stored in our warehouse.

3. Account Registration

To use certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Membership Plans and Fees

Package PR offers various membership plans with different features and pricing. By subscribing to a membership plan, you agree to pay the applicable fees as described on our website.

We reserve the right to modify, terminate, or otherwise amend our offered membership plans at any time. We will provide notice of any material changes to our membership plans.

4.1 Additional Fees and Charges: In addition to your membership plan fees, you may be subject to additional fees and charges, including but not limited to:

• Additional Item Storage: Items beyond your plan's included limit are charged at $35 per item, with discounts based on your plan tier (25% off for Basic, 35% off for Pro, and 50% off for Elite).
• Oversized Item Fee: Items exceeding the maximum cubic feet allowance for your plan will incur a fee of $5.99 per cubic foot per month.
• Special Handling Fee: Fragile, awkward, or items requiring special care will incur a fee of $15.00 per item.
• Packing Materials: Boxes, bubble wrap, tape, and other packing supplies will be charged according to our current packing price list.
• Professional Packing Service: Our team can carefully pack your items for optimal protection at a rate of $25.00 per hour.
• Item Retrieval Fee: A fee of $5.00 per item applies for retrieving specific items from storage (first 3 items free per month).
• Consolidation Fee: Combining multiple packages into one will incur a fee of $10.00 per consolidation for Basic plan members (free for Pro and Elite plans).
• Photo Documentation: Additional photos of your items beyond the standard photos included in your plan will be charged at $1.00 per additional photo.
• Inventory Management: Detailed inventory listing and labeling of items will be charged at $15.00 per hour.
• Rush Processing: Expedited processing of incoming or outgoing items will incur a fee as specified in your plan details.
• Late Payment Fee: Payments received after the due date will incur a fee of $15.00 or 5% of the outstanding balance, whichever is greater.

4.2 Fee Changes: All fees are subject to change with 30 days notice. We will notify you of any fee changes via email or through our website.

5. Storage Services

Package PR provides storage services that allow Puerto Ricans and expats to store their belongings in our secure Indiana warehouse. You agree to comply with all applicable laws and regulations regarding the storage of goods.

You are responsible for providing accurate information about the items you are storing. Package PR is not responsible for damages or losses resulting from inaccurate information provided by you.

5.1 Storage Period: Each membership plan includes a specified free storage period per item (30, 60, or 90 days depending on your plan). Additional items beyond your plan's included limit are charged at $35 per item, with plan-specific discounts (25% off for Basic, 35% off for Pro, and 50% off for Elite).

5.2 Maximum Item Size: Each membership plan specifies a maximum item size (in cubic feet). Items exceeding this size will incur additional fees as outlined in Section 4.1.

5.3 Item Consolidation: We offer item consolidation services to combine multiple packages into one. This service is included free for Pro and Elite plans but incurs a fee for Basic plan members.

5.4 Photo Documentation: We provide a specified number of photos per item as part of your plan. Additional photos can be requested for an additional fee.

5.5 Item Retrieval: You may request specific items to be retrieved from storage. A fee applies after the free retrievals included in your plan have been used.

6. Prohibited Items

You agree not to store any items that are prohibited by law or by our policies. Prohibited items include, but are not limited to, illegal drugs, hazardous materials, weapons, perishable goods, live animals or plants, and items of extraordinary value (over $5,000).

Package PR reserves the right to refuse service, terminate accounts, or report to authorities if we suspect that prohibited items are being stored through our Services.

We reserve the right to inspect any item at any time to ensure compliance with our prohibited items policy. If prohibited items are found, we may dispose of them and charge you for any costs incurred.

7. Payment Terms

You agree to pay all fees associated with your use of our Services. All payments are non-refundable unless otherwise specified in our refund policy.

If you dispute any charges, you must notify us within 30 days of the date of the disputed charge.

7.1 Billing Cycle: Your membership fee will be billed on a monthly or annual basis, depending on the billing cycle you select. Additional fees will be billed as they are incurred.

7.2 Late Payments: If your payment is more than 10 days late, we may suspend your account and access to your stored items until payment is received. A late payment fee will apply as specified in Section 4.1.

7.3 Abandoned Property: If your account remains unpaid for 60 days or more, we reserve the right to consider your stored items as abandoned property. We may sell, donate, or dispose of abandoned property to recover unpaid fees, in accordance with applicable laws.

8. Insurance and Liability

Each membership plan includes a specified level of insurance coverage per item. This insurance covers damage or loss that occurs while your items are in our care, subject to the terms and limitations of our insurance policy.

8.1 Insurance Limitations: Our insurance does not cover damage or loss resulting from:

• Pre-existing damage or defects
• Improper packing by you or a third party
• Normal wear and tear
• Inherent vice or nature of the item
• Acts of God or natural disasters
• War, terrorism, or civil unrest
• Government seizure or confiscation

8.2 Claims Process: To file an insurance claim, you must notify us within 48 hours of discovering the damage or loss. You must provide photographic evidence and a detailed description of the damage or loss.

8.3 Limitation of Liability: To the maximum extent permitted by law, Package PR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

In no event shall our total liability for all claims related to the Services exceed the greater of $100 or the amount you paid to Package PR in the past 12 months.

9. Indemnification

You agree to indemnify and hold harmless Package PR and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes to these Terms. Your continued use of the Services after such modifications constitutes your acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions.
